FMCSA Issues Truck Hours-of-Service Waiver for Fertilizer in Select States

The Federal Motor Carrier Safety Administration (FMCSA) has granted Kansas a waiver from the requirements of 49 CFR 395.3 (governing maximum driving time for property-carrying vehicles) and 49 CFR 395.8(a)(1)(i) (requiring truck drivers to use an electronic logging device to record duty status) for “Motor carriers and drivers transporting straight or blended fertilizer products for commercial farming and agriculture purposes.”

States included in the waiver are: Alabama, Arkansas, California, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, Washington, West Virginia, Wisconsin and Wyoming.

The waiver, which is effective May 26, 2026, and expires on August 26, 2026, does not apply to the transportation of hazardous materials and is subject to additional terms, conditions, and restrictions. The text of the waiver can be read in full by clicking the button below.

The waiver announcement follows the Trump Administration’s waiver of the Jones Act governing vessels transporting fertilizer and other named goods between two U.S. destinations.
